1. Subject of the Contract

Snowsport Seefeld GmbH offers ski and snowboard lessons, private instruction, and other

snow sports services. The following terms and conditions govern the contractual relationship

between the ski school and the course participants.

2. Contract Conclusion & Booking

A contract is concluded upon the customer's booking and the ski school's confirmation.

Bookings can be made online via the booking system, by email, or in person. The contract becomes binding upon confirmation of the booking.

3. Prices & Payment

All prices are stated in euros and include applicable VAT. Payment can be made via the online payment system (Stripe), by credit card, or in cash before the start of the course. The full amount is due before the course begins.

4. Right of Withdrawal

For online bookings, a 14-day right of withdrawal applies according to the Austrian Distance and Out-of-Business-Premises Contracts Act (FAGG), starting on the day the contract is concluded (booking). Within this period, the customer may withdraw from the contract without giving any reason.

However, the right of withdrawal expires prematurely if the course begins within this 14-day period, the service is fully rendered, and the customer has expressly agreed that the ski school may begin providing the service before the end of the withdrawal period, thus waiving their right of withdrawal.

5. Cancellations & Withdrawal

Cancellations must be made in writing by email to: info@snowsportseefeld.at with the subject line "Cancellation". The following conditions apply:

Up to 7 days before the start of the course: Free cancellation. For payments made by credit or debit card (both online via our booking system and in our office), in the event of a refund, the amount will be reduced by the processing fee incurred during the payment transaction, which is 1.5% of the payment amount plus €0.25 per transaction. These costs represent expenses already incurred and are non-refundable.

6 to 2 days before the start of the course: 50% of the course fee will be charged.

1 day before the start of the course or in case of no-show: 100% of the course fee will be charged.

In case of illness, the course fee will be refunded upon presentation of a doctor's certificate, less any processing fees incurred during the original payment (card or online).

6. Fitness, Health & Equipment

Participation in our courses requires that participants are physically fit and have no health conditions that could jeopardize their safe participation in the lessons. Any limitations or illnesses must be reported to the ski school before the start of the course.

Each participant is responsible for having technically sound and up-to-date safety equipment. The ski school assumes no liability for accidents or damage caused by defective, improperly adjusted, or unsuitable equipment. Equipment adjustments must be performed by a professional ski shop. For those using their own equipment, the responsibility for its condition and insurance lies solely with the customer.

7. Helmet Requirement & Safety Recommendations

Wearing a helmet is mandatory for children and teenagers when skiing and snowboarding. For adults, we strongly recommend wearing a helmet.

Please note that in the event of an accident without a helmet, insurance coverage by accident or health insurance may be limited or denied. For safety reasons, we strongly advise all participants to wear a helmet throughout the entire lesson.

8. Liability

The ski school is liable only for damages caused intentionally or through gross negligence. No liability is assumed for any fault or negligence on the part of the participant, defects in equipment, weather conditions, or services provided by third parties.

9. Changes to Services / Cancellations

The ski school reserves the right to combine courses if there are insufficient participants, to change course times or locations, or to substitute instructors.

In the event of cancellation due to force majeure (e.g., adverse weather conditions, official closure), no claim for performance can be made. Any fees already paid for services not yet rendered will be refunded. At the customer's request, a rebooking or the issuance of a voucher may be offered instead of a refund. For refunds of payments made online via our booking system or by card at our office, the processing fees incurred during the payment transaction (1.5% of the payment amount plus €0.25 per transaction) will be deducted.

10. Applicable Law & Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, the mandatory provisions of the law of their place of residence apply. of the customer's country of residence.

The place of jurisdiction for business customers is Innsbruck, Austria.

11. Severability Clause

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the corresponding statutory provision.
